Terms of Use

These terms are between you and Aardvark Software LLC ("we", "us") and cover the Aardy apps for Apple TV, iPhone, Mac and Windows, and this website. By installing or using Aardy you agree to them.

License

We grant you a personal, non-exclusive, non-transferable, revocable license to use Aardy on your own devices for personal, non-commercial purposes. We keep all rights in Aardy. You may not copy, modify, reverse engineer or redistribute it, except as the law allows.

Aardy for Apple TV: one-time purchase

Aardy for Apple TV is sold through the App Store for a one-time price (currently US$4.99). It is not a subscription and has no in-app purchases. Your purchase covers Apple TVs signed in with the Apple ID that bought it and, if you enable it, your family through Apple Family Sharing. Payment, taxes and refunds are handled by Apple under Apple's terms.

Free apps

Aardy for iPhone, Mac and Windows are free. The Mac and Windows apps run on your computer and serve your own library to your own TVs. You are responsible for your network, your passwords and your backups.

Your content

Your photos, music and other content remain yours. You must have the right to use anything you display with Aardy. We do not receive your content; see the Privacy Policy.

Acceptable use

Do not use Aardy unlawfully, to infringe others' rights, or to attack or overload any network or service, including MET Norway and other third-party data sources.

Third-party data

Weather, place and landmark data come from third parties (MET Norway, GeoNames, OpenStreetMap contributors) under their own licenses and may be inaccurate or unavailable. See credits.

Updates and availability

We may update, change or discontinue features. We will try to keep the apps working but do not promise uninterrupted service.

No warranty

Aardy is provided "as is" and "as available", without warranties of any kind, to the fullest extent permitted by law.

Limit of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental or consequential damages, or for loss of data, and our total liability for any claim is limited to the amount you paid for the app (US$0 for the free apps). Some places do not allow these limits, so they may not apply to you.

Apple terms (Apple TV and iPhone apps)

• These terms are between you and us, not Apple. We, not Apple, are responsible for the app and its content.
• Apple has no obligation to provide maintenance or support.
• If the app fails to meet a warranty, you may notify Apple for a refund of the purchase price; Apple has no other warranty obligation for it.
• We, not Apple, handle claims about the app, including product liability, legal compliance and intellectual property claims.
• You confirm you are not in a country subject to a US embargo and not on a US prohibited-party list.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
• You must comply with applicable third-party terms, such as your network provider's.

Ending these terms

You may stop using Aardy at any time by uninstalling it. We may end your license if you break these terms.

Governing law

These terms are governed by the laws of the State of Wyoming and the United States, without regard to conflict-of-law rules. Local consumer-protection law that cannot be waived still applies.

Changes

We may revise these terms and will post the new version here with a new effective date. Continued use means you accept it.
